In his statement on Instagram, Romo also spoke about taking "full responsibility."

Romo was arrested on July 23, in Milwaukee County, Wisconsin. He was suspected of driving while intoxicated, which is called OWI in Wisconsin.

According to the police report, deputies stopped Romo’s black Jeep after they saw him pass other cars on the right. He was driving south on Interstate 43.

Police said Romo used a “gore area” while passing the cars. This is the paved area between the interstate lanes and an entrance ramp.

Body camera video reportedly showed that Romo had red, glassy eyes. Officers also said they could smell alcohol.

Romo told the officers that he was coming from a golf course and was going to visit his grandparents.

He took a field sobriety test but did not pass it. He was then arrested, booked and later released.

Police also found an open bottle of alcohol on the passenger side of his Jeep during a search before the vehicle was towed.

Romo first got a citation for refusing to take a chemical breath or blood test. The citation was later changed to include three more offenses.

They were a first-offense OWI, having an open alcoholic drink in a vehicle and unsafe passing on the right.

In Wisconsin, a first-offense OWI is considered a civil offense and not a criminal misdemeanor.

Tony Romo could have to pay more than $1,300 in fines. He is scheduled to appear in court on Sept. 21, 2026.

The incident has also affected Romo's job as a broadcaster. CBS Sports placed him on indefinite leave after his arrest.

Former NFL star J.J. Watt was brought in to temporarily replace Tony Romo. Watt will work alongside Jim Nantz on CBS Sports' top broadcast team.

In July, criminal attorney Megan Harrington gave her thoughts on Tony Romo’s recent OWI arrest after watching the bodycam video released by TMZ.

After the video came out, Harrington shared her opinion on X. She also said she would be ready to take Romo’s case.

In the video, Tony Romo tells the officer that he was coming from a golf course and was going to meet his grandparents. The officer then asked him to get out of the car and take a field sobriety test.

Romo first said no and told the officer that he wanted to speak to his lawyer. He later agreed to take the test. He was then handcuffed, and the officer told him he was being detained as part of an OWI investigation.

Harrington later made another post explaining why she thought some things could work in Tony Romo’s favor.

She also questioned whether the officer had enough reason to turn the traffic stop into an OWI investigation.

Harrington also said Tony Romo asking for a lawyer should not be seen as a sign that he was guilty.
